Colin v Cuthbert – the war of the caterpillars has come to a close

Who could forget the great Aldi/M&S stand off of 2021?

On the off chance that you need a refresher –

In April of 2021, Marks and Spencer took legal action against Aldi following a claim that the German retailer had infringed the trademark of its iconic Colin The Caterpillar cake. M&S claimed that the similarity of Aldi’s cake could lead consumers to believe that they are of the same standard and allows Cuthbert to “ride on the coat-tails” of Colin’s reputation. The battle of the bugs was on.

M&S wanted Aldi to remove the product from sale and agree not to sell anything similar in the future.

Fast forward to today, and the two retailers appear to have reached an agreement in the dispute over the design of their caterpillar cakes.

According to Sky News, both supermarkets have confirmed that “a deal has been struck”, and in May, Cuthbert was back on Aldi shelves after a few changes to his design.

According to our friends at HER, an Aldi spokesperson confirmed yesterday that Cuthbert is now “free and looking forward to seeing all his fans again very soon.”

Colin the Caterpillar declined to comment.
